Terms of service

These Terms of Service ("Terms") apply to your use of povdepot.com and to any order you place with POV Depot ("we", "us"). By using the site or placing an order, you agree to these Terms.

1. Who we are

POV Depot is an independent retailer. We are not affiliated with, endorsed by or sponsored by GoPro, and we are not an authorized GoPro dealer. GoPro and HERO are trademarks of GoPro, Inc. and are used on this site only to identify the product we sell.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

3. The product and its condition

We sell a refurbished (open box) GoPro HERO13 Black, model CHDHX-131-RW, US version. It is an open-box or display unit, not a new camera, and it was not refurbished by GoPro. It may show light cosmetic marks that do not affect how it works. Photos on the site are stock photos of the model. Details are on Condition: open box.

4. Prices and payment

Prices are shown in US dollars. Any sales tax that applies is calculated at checkout. We may change prices at any time, but a change does not affect an order you have already placed. Payment is taken when you place your order.

5. Orders

Your order is an offer to buy. We may decline or cancel an order, for example if the item is out of stock, if there is an error in the price or description, or if we suspect fraud. If we cancel an order you have paid for, we refund you in full.

6. Shipping

We ship to the contiguous United States. See the shipping policy.

7. Returns and refunds

You may return the camera within 30 days of delivery. See the refund policy.

8. Warranty

POV Depot provides a 1-year warranty on the camera. It is our warranty, not GoPro's. Open-box units sold by an independent retailer may not be covered by GoPro's own warranty. See the warranty terms.

9. Accuracy of information

We try to keep the information on this site accurate and up to date. If we find an error, we will correct it, and if it affects an order you placed, we will contact you.

10. Use of the site

You agree not to use the site for anything unlawful, to interfere with how it works, or to copy its content for commercial use without our permission.

11. Disclaimer

Apart from the warranty and policies described above, the site and the product are provided "as is" to the extent the law allows. Some states do not allow the exclusion of implied warranties, so this may not apply to you.

12. Limitation of liability

To the extent the law allows, our total liability for any claim related to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses, including lost footage or data. Nothing in these Terms limits liability that cannot be limited by law.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. This does not take away any consumer protection you have under the law of the state where you live.

14. Changes to these Terms

We may update these Terms. The version on the site when you place your order is the one that applies to that order.
